... for the State Mr. De, learned Advocate, appears on behalf of the appellant being appointed through High Court Legal Services Committee. He submits by referring to the judgment of the Trial Court dated 17th February, 2009 that the appellant has already admitted the fact of his nationality being Bangladeshi, before the Trial Court and he has referred to the order of the Trial Court that upon admission of the above fact by the appellant, the Trial Court has directed for his repatriation.
It has been brought to the notice of the Court that since 2008, the appellant was in judicial custody and it is submitted that after serving the sentence, the appellant must have been deported to his native country by this time, by the appropriate authority.
It is found proper that a report as regards the appellant be sought for from the DIG prison. The DIG shall submit his report within one week after the Puja Vacation.
Let the matter appear in the list on 11th November, 2022.
