The petitioner being the accused in connection with Bidhannagar Cyber Crime Police Station Case No.58 of 2022 under Sections 420/468 of the Indian Penal Code with added Sections 384/500/506/509 of the Indian Penal Code presently pending before the learned Additional Chief Judicial Magistrate at Bidhannagar being G.R. Case No.400 of 2022 has prayed for quashing of the said proceeding on the ground that petitioner was the employer of the de- facto complainant/opposite party No.2. After the opposite party No.2 2 was terminated from service, she has lodged a false complaint against the petitioner.
I have gone through the entire record. I have also heard the learned Advocate for the petitioner. I do not find any reason to entertain the instant revision.
However, the instant revision is disposed of directing the Investigating Officer to serve notice under Section 41A of the Code of Criminal Procedure to the petitioner for interrogation. Prior to such interrogation, the Investigating Officer shall not take any coercive step against the petitioner.
The instant revision, is, thus, disposed of.
