The Court : This is an application under Order XIII-A of the Commercial Courts Act, 2015 for summary judgment. Learned counsel appearing for the plaintiffs places Order XIII-A and submits that the defendants will have to be given leave to file their response. 2
Upon considering the relevant provision, namely, Order XIII-A Rule 2 and 3, the defendants are directed to file an affidavit within two weeks from date.
It may be noted that the notice of the application was received by the defendants on 24th December, 2020. Learned counsel appearing for the defendants is requested to consider the relevant provision under Order XIII-A for filing the reply.
