1. The matter was listed on 18th and 19th May 2026. During this hearing, Mr. Kakade, learned Additional Government Pleader reiterated that the State has filed an affidavit dated 14 th May 2026 wherein, it is stated that the Petitioners were afforded a hearing on 6th April 2026. On our query, the learned Additional Government Pleader submitted that without prejudice to the above contentions, Respondent Nos.1 to 3 are ready and willing to grant a fresh hearing on 19 th or 20th May, 2026, under Section 15(1) of the Right to Fair Compensation and Transparency in Land Wakodikar 1/2 ::: Uploaded on - 22/05/2026 ::: Downloaded on - 23/05/2026 01:16:07 ::: 2-WP-5685-2026.doc Acquisition, Rehabilitation and Resettlement Act, 2013. This was to obviate any delays in the acquisition process.
2. There were connectivity issues and Mr. Ahuja, learned counsel for the Petitioners who was appearing through video - conferencing could not be heard by this Court on the above dates. Hence the matter was listed today. We had also indicated to the learned counsel assisting Mr. Ahuja, who was physically present in Court on both occassions of the proposed course of action and directed the learned counsel to obtain instructions from the Petitioners and/or argue the matter. Even today, there are connectivity issues at Mr. Ahuja's end and we are unable to hear him. Mr. Magam, learned counsel assisting Mr. Ahuja is present before this Court, however, without any instructions. No orders are required to be passed in favour of the Petitioner.
3. If the Petitioners are not willing to attend the hearing, then the acquisition process cannot be hindered.
4. List the matter on 22nd June 2026.
