1. Heard learned counsel for the petitioner.
2. Issue notice to the respondents, returnable on 18th June 2026.
3. Mr. Shinde, learned AGP, waives service of notice on behalf of Respondent No.11.
4. Learned counsel for the Petitioner invited my attention to page No.18, whereby the Deputy Charity Commissioner, Ahilyanagar, by order dated 05th May 2026, rejected Change Report No.1034 of 2003. She further invited my attention to page No.23, whereby Clause Shrikant Malani Page 1 of 2
4.WPST.14697.2026.odt (4) appears to have been inserted to the effect that, in the meanwhile, the names of the de-facto trustees who had worked be recorded.
Prima facie, once the final order was passed, it was not appropriate on the part of the authority to subsequently insert a clause which did not form part of the original order.
4. In view thereof, I am inclined to grant interim relief in terms of prayer clause (c).
5. Accordingly, there shall be interim relief in terms of prayer clause (c), which read as under :
"C) Pending hearing and final disposal of this Writ Petition, grant stay to the further effect, implementation, operation and execution of order dated 07/05/2026 below exhibit 81 and the consequential amendment made in order dated 05/05/2026 passed in Change report no 1034/2003 by respondent 11 and for that purpose issue necessary order."
