1. Heard the learned counsel for the applicants and the
learned APP for the respondent - State.
2. The applicants apprehend arrest in connection with Crime
No.0129 of 2026 dated 07 th April 2026, registered with Cantonment
(Chawani) Police Station, Dist. Chhatrapati Sambhajinagar, for the
offences punishable under sections 80, 85, 115(2), 352, 351(2),
351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Issue notice to the respondents, returnable on 18th June
2026.

4. Learned APP, waives service of notice on behalf of
respondent - State.
5. The learned counsel for the applicants submits that the
applicants are residing separately and were not present at the place of
occurrence at the time of the alleged incident.
5. Considering the allegations made in the First Information
Report and the role attributed to the applicants, this Court is satisfied
that the applicants have prima facie made out a case for grant of
interim protection. Hence, interim protection deserves to be granted in
their favour. Accordingly, the following order is passed :
ORDER
(a) Till the next date of hearing, in the event of arrest of the applicants, namely, (1) Vijay Bhima Magre and (2) Vaishali w/o Vijay Magre, in connection with Crime No. 0129 of 2026 dated 07 April 2026 registered with Cantonment (Chawani) Police Station, District Chhatrapati Sambhajinagar, for the offences punishable under Sections 80, 85, 115(2), 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, they shall be released on bail on Shrikant Malani Page 2 of 3
43.ABA.821.2026.odt executing P.R. Bond and Surety Bond in the sum of ₹15,000/- each, with one solvent surety in the like amount.
(b) The applicants shall attend the concerned Police Station on every Thursday and Sunday between 10:00 a.m. and 02:00 p.m. till filing of the charge- sheet.
(c) The applicants shall not tamper with the prosecution evidence in any manner.
(d) The applicants shall cooperate with the Investigating Agency.
