1.                 Heard the learned counsel for the applicant and the

learned APP for the respondent - State.

2.                 The applicant apprehend arrest in connection with Crime

No.0149 of 2026 dated 13th March 2026, registered with Hingoli Rural

Police Station, for the offences punishable under sections 118(1),

118(2), 115(2), 351(2), 352, 189(2), 191(2), 191(3) and 190 of the

Bharatiya Nyaya Sanhita, 2023.

3.                 Issue notice to the respondents, returnable on 18th June

2026.

4.                Learned APP, waives service of notice on behalf of

respondent - State.

5.                The learned counsel for the applicant submits that the

alleged incident took place on 07 th March 2026, whereas the First

Information Report came to be lodged after a delay of seven days. He

submits that the FIR is an afterthought and that all family members

have been roped in falsely. It is further submitted that the applicant is

aged about 75 years.

6.                Considering the allegations made in the First Information

Report and the role attributed to the applicant, this Court is satisfied

that the applicant has prima facie made out a case for grant of interim

protection. Hence, interim protection deserves to be granted in favour

of the applicant. Accordingly, the following order is passed :

                                     ORDER

(a) Till the next date of hearing, in the event of arrest of the applicant, namely, Pandurang s/o Kundlik Sarkate, in connection with Crime No.0149 of 2026 dated 13th March 2026 registered with Hingoli Rural Police Station, for the offences punishable under Sections 118(1), 118(2), 115(2), 351(2), 352, Shrikant Malani Page 2 of 3

44.ABA.820.2026.odt 189(2), 191(2), 191(3) and 190 of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on executing P.R. Bond and Surety Bond in the sum of ₹15,000/-, with one solvent surety in the like amount.

(b) The applicant shall attend the concerned Police Station on every Thursday and Sunday between 10:00 a.m. and 02:00 p.m. till filing of the charge- sheet.

(c) The applicant shall not tamper with the prosecution evidence in any manner.

(d) The applicant shall cooperate with the Investigating Agency.
