1. Heard.

2. Challenge is to the order passed by the respondent Committee. The claim of the petitioner that he belongs to "Kachhi" Other Backward Class is invalidated. Challenging the findings given by the Committee, learned Counsel for the petitioner Mr. S. O. Ahmed has argued that the cut off date of considering the document was 13.10.1967 and he had produced the documents pertaining to his great grandfather and grandfather, which were prior to 13.10.1967. He therefore further submits that had those documents been taken into consideration, the result would have been different. He further submits that the petitioner is a student of first year of M.B.B.S. course and therefore he be protected.

3. Per contra, the learned Assistant Government Pleader Ms. Deepali Sapkal has argued that the order passed by the Committee is based on proper appreciation of material.

4. Since, prima facie the documents produced by the petitioner of his great grandfather and grandfather were not looked into by the Committee, I am inclined to pass the following order :

                                      (i)     Stand over to 11.06.2026.

                                      (ii)    In the meanwhile, there shall be stay in terms of prayer
                                              clause (ii).

(iii) The learned Assistant Government Pleader to file reply.
