                        2.                Issue notice to the non-applicant, returnable on
                        10.6.2026.


                         CRIMINAL APPLICATION (APPR) NO. 118 of 2026


                                          Heard learned counsel for the applicants.


                        2.                In short, it is his submission that the applicants
                        were convicted and punished for commission of offence
                        punishable under Section 138 of the Negotiable Instruments
                        Act and were directed to pay compensation of Rs. 1,60,000/-
                        each by the trial Court.


                        3.                Being aggrieved, the applicants preferred Appeal
                        before the Appellate Court and on 12.5.2026, the Appeal came
                        to be dismissed. It is his contention that after pronouncement

    of the judgment by the Appellate Court, the applicants are
    taken into custody. He submits that the applicant no.1 is the
    husband of applicant no.2. He further invited my attention to
    the receipt which is at page no. 91 and contended that the
    entire compensation amount is deposited with the Appellate
    Court.


    4.           Considering the fact that the compensation amount
    is already deposited and the applicant nos. 1 and 2 are not
    habitual offenders, so also, the applicant no. 2 is a lady, till
    filing of reply, the following order is passed:


                                 ORDER

1. The sentence imposed by the Trial Court in Summery Criminal Case No. 20474/2006, dated 20.6.2017, shall stand suspended till the next date.

2. The applicants, namely, Shri Avinash s/o Tukaramji Yawalkar and Sau Vaishali w/o Avinash Yawalkar, shall be released on furnishing a P.R. bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with one solvent surety in the like amount.

3. Issue notice to the non-applicant, returnable on 10.6.2026.
