1. Heard.

2. The original accused has preferred the present application challenging the Judgment passed by the trial Court as well as the Appellate Court convicting him for the offence punishable under Section 138 of the Negotiable Instrument Act, 1881.

3. The learned Counsel Mr. Sanket Bhalerao for the accused/applicant has submitted that the Trial Court has ordered the accused to pay compensation amount of Rs.3,08,098/- to the complainant within 30 days. According to him, the amount of Rs.61,620/- is already deposited with the Appellate Court. He, on the instructions taken from the applicant, who is present in the Court has made a statement that the remaining amount of Rs.2,46,478/- will be deposited with the Registry of this Court within a week from today.

4. In view of the statement made by the learned Counsel for the applicant/accused and considering the fact that the applicant/accused is present in the Court, thus in deemed custody, following order is passed :

(i) The sentence imposed by the Judicial Magistrate, First Class Court No.5, Amravati in Summary Criminal Case No.2541/2016, on 08.02.2023, shall stand suspended on depositing amount of Rs.2,46,478/- (Rs. Two Lakh Forty Six Thousand Four Hundred and Seventy Eight only) with this Court.
(ii) The applicant/accused be released on furnishing Personal Bond and Surety Bond of Rs.25,000/-.
(iii) The Registry is directed to accept the amount of Rs.2,46,478/- (Rs. Two Lakh Forty Six Thousand Four Hundred and Seventy Eight only) within one week from today.
(iv) Issue notice to the respondent, returnable on 10.06.2026.
