1. Heard learned counsel for the parties. Mr. Samantray, learned counsel for the Petitioner would submit that the Petitioner has been a bona fide Prospective Purchaser of the subject property.
2. A specific query was put to the learned counsel for the Respondent
- Bank as to whether the amount of Rs. 90 lakhs had been forfeited by the said bank. Upon instructions, learned counsel for the Respondent Bank now states that the said amount has not been forfeited.
3. In the given factual matrix, we deem it appropriate to direct the Respondent - Bank to refrain from dealing with the said amount, in any Mayur Page 1 of 2 ::: Uploaded on - 14/05/2026 ::: Downloaded on - 14/05/2026 20:58:35 ::: 3-WP(L)-17030-2026 (OS).doc manner, until the next date of hearing of this Petition.
4. Needless to state, the DRT shall not be influenced by the order passed today, and the proceedings sub judice before it, may continue independently on their own merits and in accordance with law.
5. List the proceedings on 10th June 2026.
