1. Heard learned counsel appearing for the Petitioner. The learned counsel states that by the impugned judgment and order dated 13 April 2026 passed by the learned Presiding Officer, Maintenance and Welfare of Parents and Senior Citizens Tribunal-1 and Deputy Collector, Greater Mumbai the Petitioner is directed to handover possession of the residential flat. He has invited our attention to the order dated 13 April 2026, more particularly to paragraph 3 thereof. He states that due to the pendency of the reference before the Larger Bench, the authorities are not taking his Appeal and therefore he has approached this Court directly. He states that he is residing in the said premises and that if he is asked to vacate the premises he will have nowhere to go.

2. In light of the above, Issue Notice to the Respondents, returnable on 16 June 2026. The Petitioner is at liberty to serve the Respondents privately as well.

3. In the interregnum, clause No.3 of the Impugned Order dated 13 April 2026, will not be acted upon until the next date.

4. Stand over to 16 June 2026.

5. All concerned to act on an authenticated copy of this order.
