1. Heard learned Counsel Mr. Kocharekar for the applicant and Ms. Kak, learned APP for the State.

Learned Counsel appearing for the applicant invited my attention to the First Information Report bearing No. 279 of 2026 at Wakodikar 1/3 ::: Uploaded on - 14/05/2026 ::: Downloaded on - 14/05/2026 20:48:05 ::: 9-ABA-1062-2026.doc page 13 of the application. The FIR is filed under the provisions of Sections 109, 118(1), 115(2), 352, 351(2), 351(3), 189(2), 189(4), 191(2), 191(3), 190, 329(3) and 324(4) of the Bharatiya Nyaya Sanhita, 2023. Learned Counsel appearing for the applicant states that this is a case of cross FIRs which are filed by both the parties.

The complainant had contended in his complaint that at about 8.30 a.m. on 12th March, 2026, the complainant and his brother went to Nishan (non-applicant) and asked about the encroachment on his land. It is alleged in the complaint that thereafter, the applicant alongwith other persons came there and threatened them by showing knife and wooden loft. Learned Counsel appearing for the applicant states that the other two co-accused have been granted interim protection in Criminal Anticipatory Bail Application Nos. 927 of 2026 and 989 of 2026. He states that the role assigned to the applicant is almost the same. He states that the Injury Certificate also does not show that, the offence as stated in the FIR is made out.

4. I have perused the FIR. I have also perused the Injury Wakodikar 2/3 ::: Uploaded on - 14/05/2026 ::: Downloaded on - 14/05/2026 20:48:05 ::: 9-ABA-1062-2026.doc Certificate as well as statements recorded by the Investigating Officer. Hence, issue notice to the respondents returnable on 18 th June, 2026.

5. Till the next date, in the event of arrest, the applicant - Deepak Pandurang Jadhav shall be released on bail in connection with C.R.No279 of 2026 registered with Bhivandi Taluka Police Station, Thane Rural, for the offences punishable under Sections 109, 118(1), 115(2), 352, 351(2), 351(3), 189(2), 189(4), 191(2), 191(3), 190, 329(3), 324(4) of the Bharatiya Nyaya Sanhita, 2023, on furnishing P.R. bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

6. The applicant shall attend the concerned Police Station as and when called.

7. Stand over to 18th June, 2026.
