Mr. R.M. Pande, counsel for petitioner.
Ms. Kolhe, AGP for respondent/State.
CORAM: RAJNISH R. VYAS, J.
DATED : 13/05/2026
1. Heard.
2. Challenging the findings given by the Scrutiny Committee i.e. respondent No.1, counsel for petitioner has argued that document mentioned at Sr. No. 5 and 6 was ignored by the Committee on the ground that same was in a torn condition. He submits that had these document been considered by the Committee, the result would have been different.
3. Per contra, learned AGP submits that the documents filed on record, more particularly at Page No. 47, Sr. No. 3, 4 and 10, show that the father of the petitioner has mentioned his caste as Sutar and not as Khati.
4. Since the documents at Sr. Nos. 5 and 6 were not looked into by the committee, I find prima-facie substance in the argument advanced by the counsel for the 2 wp4112.2026.odt petitioner. Hence, the following order.
a] Issue notice, returnable after Vacation.
b] Ms. S.V. Kolhe, learned AGP waives service of notice on behalf of respondent /State and seeks time to file reply.
c] In the meanwhile, there shall be status-quo as regard the services of the petitioner.
