Heard learned Advocate Mr. Bhuta appearing for the Petitioner. He produced the list of the judgments. He relied upon the following two judgments:-
i) Rakesh Bhanot v/s. Gurdas Agro (P) Ltd.1
ii) Sheetal Gupta v/s. National Spot Exchange Ltd.2

2. Also Heard Mr. Lakhawat for the Respondent-NSEL He has apprised me on following aspects:-

(i) the provisions of Section 14 and Section 96 of IBC relating to moratoriums.
(ii) the difference about moratorium under Section 14 and Section 96 of IBC.
(iii) He has elaborately apprised me about the facts and law laid down in P. Mohanraj & ors. v/s. Shah Brothers Ispat Pvt.

Ltd.3. His emphasis is the observations in that judgment needs to be considered on the background of the corporate insolvency and interpretation of Section 14.

He also produced list of matters with details pending before the trial Magistrate.
