1 The learned APP raised a specific objection to the effect about the maintainability of the Appeal since by judgment dated 1/1/2020, the Addl. Sessions Judge, City Civil Court and Sessions Court, Greater Mumbai, has already dismissed the Appeal filed u/s.372 IPC, calling in question the acquittal of respondent no.2 for the offence punishable u/s.279 and Section 338 of IPC.
