Ms. Athalye, leaned counsel for the non-applicant No.3, makes a statement that the matter in issue is covered by the judgment of this Court in First Appeal No. 833/2017, Mahendra s/o Dadarao Gawande Vs. State of Maharashtra & Ors., decided on 11.04.2023 and the matter needs to be remanded back. Accepting which statement, the impugned order is hereby quashed and set aside and the matter is remanded back to the learned Reference Court.
3. The Application is allowed. No costs.
