P.C.:
1. The applicant is challenging the judgment and order passed in criminal appeal no.254 of 2015, by learned Sessions Court, Pune dated 30th November 2022, confirming judgment and order dated 17th April 2015, passed by the learned Judicial Magistrate, First Class, (Link Court No.8), Pune in R.C.C. No.0401309 of 2014. According to the applicant, the prosecution has not examined decoy customer and there is no material to prove the seizure of currency.
2. In that view of the matter, I pass following order:-
(i). The sentence and order passed by the learned additional Sessions Judge, Pune dated 30th 1 of 2 Tauseef Farooqui 09-REVN.452.2022.doc November 2022, in Criminal Appeal No.254 of 2015, confirming judgment and order dated 17 th April 2015, passed by the learned Judicial Magistrate, First Class, (Link Court No.8), Pune in R.C.C. No.0401309 of 2014 stands suspended till 24th February 2023.
(ii). The applicant shall be released on bail on furnishing PR bond of Rs.10,000/- and two sureties to the like amount.
3. Issue notice to respondent, returnable on 20th February 2023.
