1. The IA seeks, amongst others, an order of disclosure of assets of the judgment-debtor pursuant to an Award passed on 29 th May 2020. Learned counsel for the applicant therefore submits that although there is a petition filed under Section 34 of the Arbitration and Conciliation Act, 1996, there is no stay operating and in the execution proceedings, he seeks disclosure in terms of prayer clause (a).

2. On behalf of the respondent, learned counsel states that the petition is yet to be heard, although the same is listed.

3. Considering the fact that there is no stay operating, this order of disclosure must follow. Accordingly, I pass the following order :-

(i) Interim Application is allowed in terms of prayer clause

(a).

(ii) The affidavit-of-disclosure shall be filed on or before 9 th November 2021.
