Heard both sides.
2. The petitioner was convicted and sentenced under Section 302 read with Section 149 of the Indian Penal Code and sentenced to life imprisonment. The petitioner was undergoing the said life imprisonment in Nagpur Central Prison. 3. Learned APP pointed out that the petitioner had preferred an appeal against his conviction and sentence before the Supreme Court. The Supreme Court by judgment and order dated 5/10/2017 acquitted the petitioner. Pursuant to the said order, the petitioner has been released from the prison on 15/11/2017. In this view of the matter this petition has become infructuous, hence disposed of.
4. Rule is discharged.
