2. Appeal is allowed. The judgment and order dated passed by Additional Sessions Judge, Dhule in Sessions Case No.10 of 2001 is hereby set aside.
3. The conviction and sentence of both the accused are set aside. Both the accused are hereby acquitted of the offence for which they were charged and tried viz., Sections 302 and 201 read with Sec.34 of Indian Penal Code.
