                     ORAL JUDGMENT

This second appeal was admitted on 25/3/2004.

By this appeal challenge was set up to the judgment and decree passed by the Courts below which granted a money decree in favour of the respondent. At the time of admission of this appeal Civil Application No.160/2004 for stay and Civil Application No. 1038/2004 application for dispensing with depositing of decreetal ::: Uploaded on - 08/11/2017 ::: Downloaded on - 09/11/2017 01:03:29 ::: amount were rejected, in view of the fact that the decree is money decree.

Today when the matter was called for final hearing, the learned counsel for the appellant Shri A.A.Naik submits that he has instruction to withdraw the present appeal. Statement is accepted. The present second appeal is disposed of as withdrawn. No order as to costs. .
