2                   By judgment and order dated 17.9.2002, learned

Additional Sessions Judge, Pune convicted the petitioner along with other accused for the offence under Sections 376(2)(g), 377 and 323 read with Section 34 of IPC. The petitioner was sentenced to suffer R.I. for life and fine of Rs. 5000/- under Section 376(2)(g) of IPC and imprisonment for ten years for the offence under Section 377 read with Section 34 of IPC. Both the sentences were directed to run concurrently.

            3                   The grievance of the petitioner is that though he has

completed 14 years of actual imprisonment, his case for pre- mature release has not yet been decided by the Government. In view of the grievance of the petitioner, the Home Department, Govt. of Maharashtra, Mumbai which is the concerned department, to take a decision in the case of the petitioner for pre-mature release within a period of eight weeks from today.

4 Mr. Sandeep S. Kamble Under Secretary, Home Department, Mantralaya, Mumbai who is present in the Court, undertakes to communicate this order to the Home Department.
