DATE : 21.03.2017 ORAL JUDGMENT (PER : SMT. VASANTI A. NAIK, J.) The learned Counsel for the parties have tendered a pursis in the Court today. The same is accepted on record and marked as Exhibit - 'Z'. The pursis is signed by Sourabh Pashine, who is the appellant in Family Court Appeal No.9/2015 as also Sonam Pashine, the respondent, who is also the appellant in Family Court Appeal No.16/2015. The respondent in Family Court Appeal No.9/2015 has signed the pursis by her maiden name Sonam Katakwar though her name is mentioned as Sonam Pashine in the Family Court Appeals.
It is stated on behalf of the parties that the parties have compromised the matter in both the Family Court Appeals and Sourabh Pashine has agreed to pay a sum of Rs.10,00,000/- to Sonam Pashine ::: Uploaded on - 22/03/2017 ::: Downloaded on - 25/03/2017 00:49:37 ::: fca9.15.odt 3 (Sonam Katakwar) within a period of three months towards full and final settlement of the claim of Sonam Pashine against him. A cheque for an amount of Rs.3,00,000/- dated 27.3.2017 and drawn on the State Bank of India, Bajaj Nagar is handed over by the Counsel for Sourabh Pashine to the Counsel for Sonam Pashine (Katakwar). The learned Counsel for Sonam Pashine has acknowledged the receipt of the said cheque. It is agreed by Sonam Pashine that she would not deposit the cheque in the Bank before 27.3.2017.
The parties are personally present in the Court today. The parties state that they are ad idem over the terms mentioned in the compromise pursis. We have perused the terms of the compromise pursis. They are just and reasonable. Hence, both the Family Court Appeals are disposed of in terms of the terms mentioned in the pursis.
Since the Family Court Appeals are disposed of in terms mentioned in the pursis, a decree be drawn accordingly. No costs.
