The matter was called out yesterday and there was no appearance either for the petitioners or for respondent Nos. 1 & 3. Shri Tembhare, learned AGP appears for respondent No. 2.
2. The learned AGP has invited our attention to Civil Application No. 6147 of 2003 filed by Respondent No. 3. Respondent No. 3 has invited attention to the report filed on record by Respondent No. 1 - University, granting permission to the petitioner - society to close down subject of Electronics. By said Civil Application, request has been made to consider writ petition along with records of Writ Petition Nos. 2064 of 1987 and 1477 of 1987. The application is still pending.
3. The petitioners have filed reply thereto and opposed the application. The petitioners have thereafter filed Civil Application No. 7188 of 2003 for suitable directions. The petitioners sought quashing and setting aside of the report dated 22.03.2003 submitted by the Committee and accepted by the Vice Chancellor. 4. The application was opposed by Respondent No. 1 - University by filing reply.
5. The prayer in Writ Petition was to grant permission to the petitioners to close down Electronics subject from the Academic Year 1998-99. This prayer clause has not been amended thereafter.
6. In this situation, the challenge in the petition appears to have been rendered infructuous. We accordingly dispose of the present writ petition. All pending Civil Applications are also disposed of. Rule discharged. However, in the facts and circumstances of the case, there shall be no order as to costs.
