ORAL JUDGMENT :

2. Heard learned Additional Public Prosecutor for the respondent/State.
3. Learned Additional Public Prosecutor pointed out to me the order passed by this Court on 5 th January, 2010 while issuing Rule. By this ::: Uploaded on - 31/03/2017 ::: Downloaded on - 01/04/2017 00:39:38 ::: J-cwp685.09.odt 2/2 order, interim relief in terms of prayer clause (b), subject to the petitioner furnishing supratnama in the sum of Rs.25,000/- to the trial Court has been granted. Prayer clause (b) is about direction to release the Bajaj Auto Five wheeler bearing registration No.MH-31-CB-3505 to the custody of the petitioner. This relief, was temporary in nature and was to last till the proceedings before the Collector were disposed of in accordance with law. Such interim relief was earlier rejected the lower Court. The grievance in this petition is only about refusal to grant such interim relief by the lower Court. But, now this grievance itself has been redressed by this Court by an interim order and, therefore, now nothing survives in this petition. The petition is, therefore, disposed of in terms of interim relief dated 5th January, 2010, which shall continue till final disposal of the proceedings before the learned Collector in accordance with law.
4. Rule is made absolute in these terms.
