ORAL JUDGMENT (PER SMT. V.K. TAHILRAMANI, J.):-

Heard both sides.

2. The petitioner is facing trial in M.C.O.C. Crime No. 66/2016 which is pending before the Special M.C.O.C.A. Court at Alibaug. The prayer of the petitioner in the present petition is that the trial be expedited in the said case and to dispose of the trial in fixed time frame.

3. Learned APP stated that before the trial Court at Alibaug one expedited matter is already going on and there are many other old cases. Looking to the fact that the case is of the 2016 and there are many older matters pending before that Court, we are not inclined to expedite the trial.

4. Another grievance of the petitioner is that he has met with an accident around six years back and due to which he has problem in his left hand and he is not getting regular treatment for the same. Medical report submitted by the Chief Medical Officer, Taloja Central Prison, Navi Mumbai, where the petitioner is lodged shows that the petitioner has complaints of pain in left hand, neck and shoulder. The petitioner was earlier referred to Sir J.J. Hospital, Mumbai, on 7/1/2017 where he was properly investigated and treated and his treatment in the prison hospital is continuous and as per the guidelines of Sir J.J. Hospital, Mumbai. The report further shows that the petitioner was referred to the Municipal Corporation Hospital, Navi Mumbai, on 23/11/2017, where he was thoroughly investigated 2/3 ::: Uploaded on - 08/12/2017 ::: Downloaded on - 10/12/2017 01:30:48 :::

27. cri.wp 4174-17.doc and treated and provided proper medication. He has been advised Physiotherapy with Hot Water Fomentation. The report further shows that his general health condition is good and satisfactory. In this view, no further orders are necessary except that the Prison Authorities to provide necessary medical treatment to the petitioner as and when necessary.

5. No other directions are necessary. Rule is discharged.
