2. The applicant no. 1 is the husband whereas the applicant no. 3 is the wife. The applicant no. 2 is the mother of the husband and mother-in-law of the applicant no. 3, the original complainant. All the applicants are jointly praying for setting aside FIR No. 197/2014 registered by the respondent on 27-11-2014.

3. The learned counsel for the applicants submits that the applicant nos. 1 and 3 are personally present before the Court and she has also signed solemn affirmation consenting for setting aside FIR.

4. In view of the above, the criminal application is allowed in terms of prayer clause (i) which is reproduced below.

i) By a suitable order or direction the F.I.R. No. 197/2014 dated 27.11.2014 registered at Police Station Gondia City (Annexure-A) and Charge Sheet dated 20.12.2014 & No. 164/2014 vide Regular Criminal Case No. 442/2014 pending before the Hon'ble Chief Judicial Magistrate First Class, Gondia, (Annexure-B) for offence under section 498-A of I.P.C. may kindly be quashed and set aside.
