ORAL JUDGMENT [PER SMT. V.K. TAHILRAMANI, A.C.J.] :

1. Heard both sides.

2. The petitioner preferred an application for furlough on 27.4.2016. The said application was rejected by order dated 12.1.2017. Being aggrieved thereby, the petitioner preferred an appeal. The appeal was dismissed by order dated 9.5.2017, hence, this petition.

3. The application of the petitioner for furlough came to be rejected on the ground that he is convicted for an offence punishable under Section 376 of IPC and as per Notification dated 1.12.2015, a person who has been convicted for the offence of rape shall not be released on furlough. In view of these facts, we are not inclined to interfere. Rule is discharged.
