            2                   The petitioner is serving out sentence in Nashik Road




                                                                                                                              
            Central Prison, Nashik.                              The son of the petitioner expired on

20.9.2016. The petitioner applied for death parole to the Superintendent of Nashik Road Central Prison, Nashik, however, by order dated 21.9.2016, the said application came to be rejected. In the said order, it was informed that against this order of rejection, the petitioner may approach the Divisional Commissioner, Nashik. However, the petitioner has not approached the Divisional Commissioner, Nashik and he has directly approached this Court. Hence, it would be appropriate that the petitioner prefers an application to the Divisional Commissioner, Nashik. If such an application is preferred, the same be decided within a period of one week from receipt thereof by the Divisional Commissioner, Nashik.

Thus, we are not inclined to grant parole to the petitioner.

3 Writ petition is disposed of in above terms. Rule is discharged.
