COMMON JUDGMENT ( Per B.R. Gavai, J.)
1. Heard.
2. Rule. Rule made returnable forthwith. By consent of the parties, the petition is taken up for hearing finally.
3. The limited relief claimed in the petition is for direction to respondent nos. 2 to 5 to correct the name of the petitioner in the service book.
4. The petitioner is working with the respondent nos. 2 to 5 as Dumper Operator Grade-A. It appears that since the petitioner belongs to "Teli" community, in the village record after his father's name "Murateli" has been written. Accordingly, in the service record petitioner's name is shown as "Vithal Mukharu Murateli".
5. Undisputedly, the petitioner has completed all the necessary formalities. Not only that, but a gazette notification is also issued by the State of Maharashtra wherein his surname has been shown as "Mule".
6. We accordingly find that there is no reason why the limited relief claimed by the petitioner should not be granted.
7. The respondents nos. 2 to 5 are, therefore, directed to make necessary correction in the service book of the petitioner and change his ::: Uploaded on - 26/02/2016 ::: Downloaded on - 31/07/2016 06:29:55 ::: 3 wp516-16.odt surname as "Mule". The same shall be done within a period of four weeks from today.
8. Petition is allowed. Rule is made absolute in the aforesaid terms with no order as to costs.
