2. Heard finally by consent of the parties.

3. Though, the trial Court has made certain observations about the bar of jurisdiction of the Civil Court under Section 149 of the Maharashtra Regional and Town Planning Act, 1966. Three issues are framed for decision as under : -
i) Whether the Civil Court has jurisdiction to try and entertain the suit ?
ii) Whether the suit is properly valued ?
iii) Whether the suit is barred by limitation ?
4. The issue No.1 framed, shall cover the question as to whether the jurisdiction of the Civil Court is barred under Section 149 of the Maharashtra Regional and Town Planning Act, 1966. The Court shall decide all the three issues together afresh. The order dated 7.8.2012 decided an application under order 7 rule 11 of C.P.C. is quashed and set aside.
5. In view of the aforesaid issues the application under Order 7 Rule 11 does not survive. No costs.
