following order is passed.
(i) Appeal is allowed.
(ii) The impugned judgment and and order passed by the 3rd
Ad-Hoc Additional Sessions Judge, Sangli is quashed and set aside. The Appellant/Accused is acquitted of the offence punishable under Section 302 of the Indian Penal Code. Fine, if paid, be refunded to the Appellant.
(iii) The Appellant be released forth with unless he is required in any other case.
