The Second Appeal is preferred by the appellant against the judgment and decree dated 24.09.2001, passed in A.S.No.08 of 1998 on the file of the II Additional District Judge, Krishna District, Vijayawada, which was filed against the judgment and decree dated 31.01.1998, passed in O.S.No.16 of 1990 on the file of the Senior Civil Judge, Nuzvid.
2. On 25.09.2024, learned counsel for the appellant reported that he had no instructions from the party and as such he reported no instructions. Based on the said submissions of learned counsel for the appellant, this Court ordered notice to the appellant, but the notice sent was returned with an endorsement 'refused to receive'. It seems that appellant has no interest to prosecute the appeal.
3. Accordingly, the Second Appeal is dismissed for default. There shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated. Miscellaneous petitions pending, if any, in this appeal shall stand closed.
