Learned counsel for the appellants, Mr.B.S Venkata Ramesh, would submit that matter is settled out of the Court and he sought permission to withdraw the appeal.

2. The second appeal which is not admitted and preferred against concurrent findings of both Courts in the suit for specific performance of contract. Now the counsel for the appellants is intended to withdraw the appeal.

3. Permitted.

4. Accordingly, the present second appeal is dismissed as withdrawn No order as to costs.

Consequently, miscellaneous petitions if any, stand closed. The Interim Stay, if any, granted, shall stand vacated.
