                          A.S.No.881 of 2010

JUDGMENT:

1. When the matter is taken up for hearing learned counsel for appellants submits that the appellants paid the entire amount before the Execution Court and further submits that no cause survives for adjudication in this appeal.

2. Learned counsel for respondents is present.

3. In such a case there would be no prejudice or loss caused due to dismissal of the appeal. Despite listing the matter under the caption 'for dismissal', learned counsel for the appellants have not filed memo with regard to the termination of Execution Petition.

4. In view of the submission made by learned counsel for the appellants, this court is inclined to dismiss the appeal without going into correctness of the submission made regarding the payment of the entire decretal amount.

5. Hence, the appeal is dismissed without costs. Miscellaneous petitions pending, if any, in this appeal shall stand closed.
