CRIMINAL PETITION NO.642/2022
ORDER:-
This Criminal Petition under Section 482 of the Code of
Criminal Procedure, 1973 ( for short "Cr.P.C.") is filed seeking to
release the seized tobacco products vide F.I.R.No.6/2022 dated
08.01.2022 of Chinna Bazar Police Station, Sri Potti Sri Ramulu
Nellore District for the offences punishable under Sections 272,273
IPC, 22,23 r/w 5(1) COTP Act.
2. Heard the learned counsel for the petitioner and the learned
Public Prosecutor appearing for the respondent.
3. The counsel for the petitioner and Public Prosecutor fairly stated that the issue involved in this petition is squarely covered by order in Crl.P.No.282 of 2022 dated 27.01.2022 and requested to dispose of the petition in terms of the order in Crl.P.No.282 of 2022 dated 27.01.2022.
4. In view of the above judgment and considering that the Criminal case registered in connection with the transportation of tobacco products has been quashed by the order of this Court dated 27.01.2022 in Crl.P.No.282 of 2022, the possession of the property that was seized from the accused in connection with the said crime is to be returned to the petitioner.
5. In view of the above, this Criminal Petition is allowed and the Station House Officer, Chinna Bazar Police Station, Sri Potti Sri Ramulu Nellore District is directed to release the stock of tobacco products seized from the petitioner vide F.I.R.No.6/2022 dated 08.01.2022.
As a sequel thereto, miscellaneous applications, if any pending shall stand closed.
