                            JUDGMENT (ORAL)

Dt:02.09.2021 (per Arup Kumar Goswami, CJ) Heard Mr. K.V. Raghuveer, learned Government Pleader for Education representing the learned Additional Advocate General appearing for the appellant. Also heard Mr. Vedula Venkata Ramana, learned Senior Counsel representing Mr. Sri Vijay Mathukumilli, learned counsel for 2 respondent No.1/writ petitioner and Mr. C. Sudesh Anand, learned standing counsel for respondent No.2.

2. This writ appeal is preferred against the common judgment and order dated 07.05.2021 passed by the learned single Judge in W.P.No.1327 of 2021 and batch, insofar as it relates to W.P.No.1327 of 2021.

3. This matter relates to fixation of fees by the Andhra Pradesh Higher Education Regulatory and Monitoring Commission, in respect of which, the Government has issued G.O.Ms.No.(unnumbered), Higher Education(C.E.A2) Department, dated 08.01.2021.

4. Mr. Vedula Venkata Ramana, learned senior counsel, submits that respondent No.1/writ petitioner-institution was closed down and the directions issued by the learned single Judge are in no way going to enure to the benefit of the institution and therefore, for all practical purposes, the writ appeal has been rendered infructuous.

5. However, it is submitted by Mr. K.V. Raghuveer that disposal of this case as infructuous would have impact on the other writ appeals preferred against the very same common judgment and order.

6. In view of the above submissions, we dispose of the writ appeal as infructuous making it clear that the appellant will be entitled to argue on merits in respect of other appeals preferred against the same common judgment and order. No order as to costs. All pending miscellaneous applications shall stand closed.
