                        The learned counsel, apart from raising
                   several   contentions      and   relying   on   the
                   judgment of the Hon'ble Supreme Court in
                   Deepali Gundu Surwase Vs. Kranti Junior
                   Adhyapak Mahavidyalaya (D. Ed.) and Ors,
                   reported in 2013 (10) SCC 324, contends that
                   the 3rd respondent-Labour Court grossly erred

in not awarding back wages, though a direction was issued to reinstate the petitioner giving continuity of service. He also submits that the Labour Court recorded findings in favour of the petitioner to the effect that he is not negligent at the time of accident.
