WRIT PETITION NO.23974 OF 2021
ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"To issue Writ of Mandamus declaring the inaction of the Respondents more particularly the action of the Respondent No 4 in not issuing the Death Certificate of the petitioner husband P Sudhakar Reddy who died on 17.03.2017 despite of the representations dated 09.04.2021 and GramaWard Sachivalayam Application dated 09.09.2021 and transaction No LRBD012002108138 as being illegal arbitrary Articles 14 and 21 of the constitution of India violation of Registration of Births and Deaths Act and rules made thereunder and consequently direct the Respondents more particularly Respondent No 4 to issue death certificate in pursuance of the application of the petitioner dated 09.09.2021 made through Grama Ward Sachivalayam transaction No LRBD012002108138 and direct Respondent No.4 to issuing Death Certificate of petitioners husband Parvathareddy Sudhakar Reddy of Andagundala village within the jurisdiction of the Tada Mandal"
Though the petitioner made several allegations against the respondents, during hearing, Sri M. Delhi Babu, learned counsel for the petitioner limited his request to dispose of the Mee Seva Application No. LRBD012002108138 dated 09.09.2020 submitted by the petitioner, without touching the merits of the case.
Learned Assistant Government Pleader for Revenue appearing for respondents readily agreed to dispose of the Mee Seva Application LRBD012002108138 dated 09.09.2020 submitted by the petitioner, if any, pending with the respondent-authorities.
Recording the submission of the learned Government Pleader for Revenue, I need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court MSM,J WP_23720 _2021 2 in "The Government of India v. P.Venkatesh1", wherein the Apex Court held that, such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to dispose of Mee Seva Application No.LRBD012002108138 dated 09.09.2020 submitted by the petitioner, I find no other alternative, except to issue such direction.
With the above direction, writ petition is disposed of, directing Respondent No.7-Tahsildar, Varadayapalem Mandal, Chittoor District, to dispose of Mee Seva Application No. LRBD012002108138 dated 09.09.2020 submitted by the petitioner within four (04) weeks from the date of receipt of a copy of this order, if the said Mee Seva application is in compliance of the mandatory requirement under the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971(Act No. 26 of 1971) and rules framed therein. No costs.
Consequently, miscellaneous applications, pending if any, shall stand closed.
