                WRIT PETITION No.4453 OF 2019


ORDER:-

       This Writ Petition is filed under Article 226 of the

Constitution of India, seeking to following relief/s:-

       "... pleased to declare the action of the respondent

Nos.3 and 4 in removing the petitioner from her post as Anganwadi Helper of Bendapudi Village, Thondangi Mandal of Tuni Rural Project, East Godavari District from January, 2019 onwards without there being any notice and appointing the 5th respondent as Anganwadi Helper is opposed to principles of natural justice as well as contrary to orders passed in W.P.No.31374 of 2015 dated 16.11.2015 and illegal, arbitrary further contemptuous in nature consequentially direct the respondents to restore the post of the petitioner ofj Anganwadi Helper to the village of Bendapudi of Thondangi Mandal, Tuni Rural Project of East Godavari District forthwith and pass such other order or orders ..."

Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner requested this Court, without touching the merits of the case, to issue a direction to the respondents to dispose of the representation dated 03.12.2018 in accordance with law.

Learned Assistant Government Pleader, readily agreed to dispose of the representation of the petitioner, dated 03.12.2018, if any, pending with the authorities.

In view of the submission of the learned Assistant Government Pleader, I need not decide the truth of otherwise of the allegations made in the petition. This Court is 2 conscious that no such direction be issued, in view of the Judgment of the Apex Court in "The Government of India V. P. Venkatesh1", wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do no service to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to dispose of the representation dated 03.12.2018, I find no other alternative except to issue such direction.

In the result, the Writ Petition is disposed of, at the stage of admission, with the consent of both counsel, directing the respondent Nos.3 to 4 to dispose of the representation dated 03.12.2018 in accordance with law, within a period of four (4) weeks from today. No costs.

The miscellaneous petitions pending, if any, shall stand closed.
