JUDGMENT:
When the matter is taken up for hearing, it is brought to the notice of this Court that a memo was filed in the Registry by the learned counsel for the appellant seeking permission of this Court to withdraw the appeal filed by him, on duly enclosing the instructions received from the appellant-insurance company through E-mail where only mentioned that a decision was taken by the insurance company to withdraw the appeal and to deposit the balance awarded amount.
Having regard to the aforementioned facts born by record, the appeal is dismissed as withdrawn. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
