SECOND APPEAL No.23 of 2018
JUDGMENT:
The Second Appeal arises against the Judgment and decree in A.S.No.25 of 2011 on the file of Senior Civil Judge, Allagadda dated 07.11.2017 confirming the Judgment and decree in O.S.No.333 of 2003 on the file of Junior Civil Judge, Allagadda, dated 06.05.2011.
The appellant herein is the appellant in the lower appellate Court and the plaintiff in the suit. The respondents herein are the respondents in the lower appellate Court and the defendant in the suit.
The plaintiff initiated action in O.S.No.333 of 2003 on the file of Junior Civil Judge, Allagadda for execution of regular registered sale deed in favour of the plaintiff in respect of the suit schedule land. Upon contesting of the matter, the trial Court dismissed the suit vide its Judgment dated 06.05.2011. Aggrieved by the same, the plaintiff preferred an appeal in A.S.No.25 of 2011 on the file of Senior Civil Judge, Allagadda. Upon hearing the matter on merits, the lower appellate Court confirmed the Judgment and decree of the trial Court believing the said finding of the trial Court vide its Judgment dated 2 07.11.2017. Assailing the same, the plaintiff preferred this Second Appeal raising certain grounds as substantial questions of law.
Upon perusal of the lower Courts' Judgments and decrees and the material available on record, this Court does not find any merit to show any indulgence as the appellant could not establish any substantial question of law for entertaining this Second Appeal.
Accordingly, the Second Appeal is dismissed. There shall be no order as to costs.
Consequently miscellaneous applications pending, if any, shall also stand closed.
