Writ Petition No.4513 of 2021 Order:

Heard learned counsel for the petitioner. In view of the settled legal prepositions of law including the judgment of the Hon'ble Supreme Court of India, any issue with regard to the recounting of votes can only be decided by the competent Election Tribunal, after going through the evidence available and also deciding on the necessity of recounting. This is not a matter, which can be agitated or heard in the writ petition. There is an effective alternative remedy.

With these observations, the writ petition is disposed at the stage of admission leaving it open to the petitioner to pursue his legal remedies. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
