WRIT PETITION No.10482 OF 2021
ORDER: (Per Hon'ble Sri Justice Joymalya Bagchi)
1. Union of India assailed the order, dated 22.01.2020, in O.A.
No.020/1057/2017, extending the benefit of Assured Career Progression
(ACP) to the respondent-employees.
2. Relying on the decision of the Tribunal in O.A.No.826 of 2016 as well as the judgment of the High Court of Punjab and Haryana in W.P. Nos.24314 and 24944 of 2008, the benefit was extended to the respondent employees by treating their initial service on casual basis from 15.04.1982. Similar benefit has been extended to various casual workers who were subsequently regularized by the Tribunal and various High Courts. Although we are informed that Special Leave Petition (Civil) No.2466 of 2019 was preferred against the order passed by the Central Administrative Tribunal, Ernakulam Bench and leave was granted, the Apex Court did not suspend operation of the said order.
3. Hence, we do not find any reason to interfere with the order impugned. Accordingly, the Writ Petition is dismissed. No order as to costs.
4. As a sequel, miscellaneous applications pending, if any, shall stand closed.
