SECOND APPEAL No.35 of 2014
JUDGMENT:
The Second Appeal arises against the Judgment and decree in A.S.No.7 of 2007 on the file of Senior Civil Judge, Avanigadda dated 09.12.2011 confirming the Judgment and decree in O.S.No.24 of 2001 on the file of Principal Junior Civil Judge, Avanigadda dated 23.01.2006.
The appellant herein is the appellant in the lower appellate Court and the defendant in the suit. The respondents herein is the respondents in the lower appellate Court and the plaintiffs in the suit.
The suit is filed for permanent injunction restraining the defendant interfering with the suit schedule property in any manner whatsoever. The suit was contested and the same was decreed in favour of the plaintiff by granting permanent injunction as prayed for. Aggrieved by the same the defendant preferred an appeal in A.S.No.7 of 2007 on the file of Senior Civil Judge, Avanigadda and considering the case on merits, the lower appellate Court dismissed the appeal by confirming the decree and Judgment of the Trial Court. Aggrieved by the same, 2 the unsuccessful defendant filed this Second Appeal raising certain grounds.
Upon perusal of the lower Courts Judgments and decrees and the material available on record, this Court finds that there is no substantial question of law for entertaining this Second Appeal.
Accordingly, the Second Appeal is dismissed. No order as to costs.
Consequently miscellaneous applications pending, if any, shall also stand closed.
