The following substantial question of law arises for determination in the second appeal. "Whether the 1st appellate court is justified in confirming the decree and judgment to the trial Court, without taking note of factum of plaintiff's lawful possession and enjoyment over suit schedule property, which is essential requirement for passing decree of permanent injunction has been confined to 1/4th of suit schedule property as per covenants of Ex.A4"
