CRIMINAL PETITION NO.4627 of 2021
ORDER:-
This petition is filed under Sections 437 and 439 of Code of the
Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking regular bail to
the petitioners/Accused Nos.1 to 3 in connection with Crime No.117
of 2021 of Markapur Rural Police Station, Prakasam District for the
offences punishable under Sections 307, 120b r/w 34 of the Indian
Penal Code, 1860 (for short IPC).
2. The case of the prosecution is that on 21.06.2021 at 4.30 a.m.
at Darimadugu village of Markapur Mandal, keeping the previous
grudges in mind, accused No.1 to 3 along with others with an
intention to kill the father of defacto complainant, attacked him with
knifes and blades and caused bleeding injuries to him.
3. Heard Sri V.Sai Kumar, learned counsel for the petitioners and
the learned Assistant Public Prosecutor appearing on behalf of the
respondent-State.
4. Learned counsel for the petitioners submits that the petitioners have not committed the offence as alleged and they are falsely implicated in this case and further submits that they were arrested on 28.06.2021 and since then they have been languishing in jail. It is submitted that the complainant borrowed money from the petitioners for his family necessities and executed a promissory note, when the complainant failed to discharge the money, they filed suit in OS.No.229 of 2021 on the file of Prl. Junior Civil Judge's Court, Markapur for recovery of pronote amount and also filed application 2 seeking attachment before Judgment. With a view to blackmail the petitioners, the complainant filed the present complaint.
5. On the other hand, the learned Assistant Public Prosecutor submits that the entire investigation is completed and they are awaiting for the wound certificate.
6. Taking into consideration the fact that the petitioners are languishing in jail from the last 56 days and entire investigation is completed, this Court deems it appropriate to grant bail to the petitioners.
7. Accordingly, this Criminal Petition is allowed. The petitioners/ A-1 to A-3 shall be enlarged on bail in Crime No.117 of 2021 of Markapur Rural Police Station, Prakasam District on execution of self bonds for Rs.20,000/- (Rupees twenty thousand only) each with two sureties for a like sum each to the satisfaction of the Court of the Additional Judicial Magistrate of First Class, Markapur, Prakasam District.
Consequently, miscellaneous applications pending, if any, shall stand closed.
