Heard Sri P.Narasimhulu, learned counsel for the
appellants and Sri K.Viswanatham, learned counsel for the
respondent.
Upon consideration of the decrees and judgments of the trial Court as well as the 1st appellate Court, since the following substantial questions of law arise for determination in the second appeal, ADMIT.
1. Whether the judgments of the Courts below are correct, when the suit is barred by limitation in respect of grant of the specific relief?
2. Whether the Courts below are correct in recording a finding that the plaintiff proved execution of agreement of sale by the deceased and readiness and willingness of the plaintiff for payment of balance sale consideration?
3. Whether the judgments of the Court below are correct in view of the discrepancies with regard to the name of the plaintiff, extent and boundaries of the land, value of the land and date of purchase of Ex.A1 and its date of execution?
Issue notice to the respondent to submit arguments in respect of above substantial questions of law(Arulmighu Nellukadai Mariamman Tirukkoil v. Tamilarasi(dead) by Lrs. (AIR 2019 SC 3027) followed).
