CRIMINAL PETITION No.2394 OF 2021
ORDER:
The petitioners are accused Nos.1 to 9 in Crime No.56 of 2021 in Aspari Police Station, Kurnool District under Sections 452, 323, 324 and 506 read with 34 IPC.
2. A perusal of the complaint shows that there are allegations which require further investigation before any conclusion can be drawn. In the circumstances, it would not be appropriate for this Court to interfere with the investigation at this stage.
4. Accordingly, this Criminal Petition is disposed of directing the Investigating Officer to consider the application of Section 41-A Cr.P.C to the petitioners strictly in accordance with the directions of the Hon'ble Supreme Court in the judgment of the Arnesh Kumar vs. State of Bihar1.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
